What is Prop 65?
Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act, is a California law that requires businesses to provide warnings about potential exposure to certain chemicals that the state has identified as causing cancer, birth defects, or other reproductive harm.
This law mandates companies to place a warning on product labels or provide notice before purchase if their products contain any listed chemicals above California’s established thresholds. Prop 65 warnings can be seen throughout California in places such as restaurants, grocery stores, hotels, schools, and amusement parks.
Why Do Some Products Have a Prop 65 Warning?
A Prop 65 warning does not mean a product is unsafe. Instead, it is a notification required by California law if an ingredient in the product exceeds 1/1000th of the "Safe Harbor Level" set by the state. While many regulatory agencies worldwide establish safety limits for chemicals, California’s thresholds are uniquely strict. No other state or country enforces Prop 65 regulations.
Many of the listed substances, including naturally occurring minerals like lead, arsenic, cadmium, and mercury, exist in soil and water. As plants grow, they absorb trace amounts of these elements, which can be present in natural food ingredients and supplements.
